1. Site owner

This site, published at ohmybitz.com, is owned by OHMYBITZ MANAGEMENT LLC, a limited liability company incorporated in the State of Florida, United States of America, with its address at 150 SE 2nd Ave STE 1403 #6495, Miami, Florida 33131.

OHMYBITZ is the trade name under which that company operates. Where this document says the house, it means OHMYBITZ MANAGEMENT LLC.

2. What this site is

OHMYBITZ is a representation house for creators of programming, technology and science communication content in Spanish. The site publishes the roster of creators OHMYBITZ represents or negotiates for, with the information each one states, and opens a way to get in touch for brands, event organizers, media outlets and creators looking for representation.

The site is informational. It does not sell any product or service online, it has no cart, it does not process payments and it does not allow an agreement to be closed from a page. Every commercial agreement is negotiated and formalized away from the site, by email and individually, according to what each brand, agency or organizer needs. What a form does is open that conversation, and the terms and conditions explain it in detail.

3. Intellectual property of the site

The design, the structure, the texts, the code, the typefaces, the logos, the icons and the rest of the elements of this site belong to OHMYBITZ or are used with the authorization of their owners, and are protected by the applicable intellectual and industrial property legislation.

You may read the site, print a page for your internal use and link to any of its addresses. Reproducing, distributing, transforming or commercially exploiting its content requires written authorization from OHMYBITZ, and presenting it as your own falls outside any authorization.

The OHMYBITZ brand and its logos are distinctive signs of OHMYBITZ. Their use requires prior authorization, even when it is informational or comparative.

4. Creator names, likeness and data

Every profile on the site publishes the name, the portrait and the audience data of a real person. Those elements belong to each creator and are published within the representation relationship or the commercial agreement that OHMYBITZ holds over that creator. OHMYBITZ does not grant the visitor any right over them.

Downloading, cropping, reusing or publishing a creator's portrait outside this site requires authorization. The same applies to the preview images that go with a page when it is shared.

If you are the creator of a profile and you want to correct a piece of data or take down a photograph, write to privacy@ohmybitz.com. The privacy policy explains the procedure and the response time.

5. Third-party trademarks and links

The names of platforms, products and companies that appear on the site belong to their owners and are mentioned to identify a channel, a format or a category. That mention does not imply any connection, sponsorship or endorsement, in either direction.

The site links to the public media kit of several creators, hosted on third party domains. Those links exist so that you can read the figures at their source. OHMYBITZ does not control those sites, is not responsible for their content or their availability, and the way they process your data is governed by their own policies.

6. Nature of the published figures and ranges

The audience, demographic and reach figures published on each profile are stated by the creator, taken from their media kit and carry their source indicated on the profile itself. They correspond to the cut-off date of that material and change over time. OHMYBITZ publishes them as it receives them and does not guarantee that they are accurate or current.

When a figure is rounded for publication, it is always rounded down, so that the published figure stays below the source or equal to it, and never above it.

The budget ranges on the forms are there to guide the conversation. They are not a rate card, they are not an offer and they do not bind OHMYBITZ or the creator. The cost of a campaign or of an appearance at an event is quoted case by case.

7. Limitation of liability

The site is published as it stands. OHMYBITZ works to keep the information correct and up to date, and even so it may contain errors, data that has fallen behind or service interruptions.

To the extent that applicable law permits, OHMYBITZ is not liable for indirect damages, for loss of profit or for loss of opportunity arising from the use of the site, from being unable to use it or from decisions taken on the basis of the information published. This clause leaves untouched the liabilities that applicable law declares cannot be waived.

The content that each creator publishes on their own channels is that creator's responsibility. The terms of a campaign, including the obligation to identify sponsored content, are agreed in the contract for that campaign and not on this site.

8. Availability of the site and changes to it

OHMYBITZ may modify, suspend or withdraw any page, profile or feature at any time and without prior notice, even when that leaves an address with no content. A withdrawn profile usually means that the representation relationship has come to an end.

9. Governing language

Spanish is the main language of this site, and the Spanish version of this document is the only authoritative one. Any version in another language exists to make reading easier and is always interpreted by reference to the Spanish text. Where the two differ, the Spanish version prevails.

10. Governing law and jurisdiction

This legal notice is governed by the laws of the State of Florida, United States of America, without applying its conflict of laws rules, and any dispute about the site is submitted to the state and federal courts sitting in Miami-Dade County, Florida.

This clause is not intended to exclude the mandatory rules that would be applicable in the place where you reside, if there are any. And regardless of the applicable law, OHMYBITZ honors personal data protection rights with the time limits and the procedure described in the privacy policy, which brings together those of the countries where it has regular contact.

11. Changes to this notice

The house may update this notice when the site, its activity or the applicable regulation changes. The version in force is always the one published at this address, with its date in the panel above. A change that materially affects your rights is announced on the site before it takes effect.
