Terms and conditions of use for the OHMYBITZ site.
THE SITE RULES and the path to a deal.
This site sells nothing. It has no cart, it does not process payments and it does not publish a standard contract, because every agreement is negotiated in full by email and drafted to fit what each brand, agency or organizer needs.
What these terms govern is the use of the site, what a form does, what value the published figures and ranges have, and the commercial rules of OHMYBITZ that apply before any negotiation.

1. Acceptance of these terms
By using this site you accept these terms. If you do not agree with any of them, the way forward is to stop using it.
These terms are read together with the legal notice, which identifies the company that owns the site and governs the intellectual property of the content, and with the privacy policy, which covers the processing of personal data. The three documents form a single set.
2. Who can use the site
The site is aimed at professionals: brand and marketing managers, agencies, event organizers, media outlets and content creators. To submit any form you have to be of legal age in your country of residence and, if you are writing on behalf of a company, have the capacity to represent it in a commercial conversation.
3. Permitted use
You may read the site, consult any profile, print a page for your internal use, share its addresses and send the forms that apply to you.
You may quote data from the site in an internal document of your company, stating the source. What you may not do is present the roster or part of it as material of your own, or use it to build a competing offering.
4. Uses that fall outside
The following fall outside the authorization of use, among others:
- Reproducing, distributing or making available the content of the site for commercial purposes without written authorization from OHMYBITZ.
- Downloading or reusing the portrait of a creator away from this site.
- Attempting to access non-public parts of the server, altering the site, introducing harmful code or interfering with how it works.
- Sending the forms with false data, impersonating a person or a company, or using them to send unsolicited advertising to OHMYBITZ.
- Using the site for an unlawful activity or one contrary to good faith.
5. The roster is a database owned by OHMYBITZ
The list of creators, with their audience figures, their topics, their formats, their markets and their country of residence, is a database that the house built, verifies and maintains. It is protected as such by the applicable rules, regardless of whether each individual item of data is public.
The systematic extraction or reuse of the roster, in whole or in a substantial part, by any means, is prohibited. That includes the use of crawling, scraping or automation programs on these pages, repeated manual copying, and the use of the content to train or feed an automated system.
OHMYBITZ watches this point and acts on it. Blocking automated access and claiming for the damage caused are the two routes it reserves.
6. Figures and ranges are not binding
The audience and demographic figures on each profile are stated by the creator, come from the media kit and carry the source they are taken from. They correspond to a cutoff date and change over time. OHMYBITZ publishes them exactly as it receives them and does not guarantee that they are accurate or current, and it does not guarantee any result in reach, in conversion or in sales from a campaign.
The budget ranges offered by the forms are there to guide the conversation. They are not a rate card, they are not an offer and they do not bind anyone. The actual cost is quoted case by case.
7. What a form does
A form on this site opens a conversation. It is not an order, it is not a booking, it is not an acceptance of an offer and it creates no obligation for OHMYBITZ, for the creator or for you.
The automatic message you receive on sending it confirms that the submission arrived, and nothing more. It does not accept a proposal and it does not confirm that anything has been contracted.
OHMYBITZ may reply, ask for more information or decline the inquiry without stating a reason. A form that has been sent gives no right to a reply within a set period, even though OHMYBITZ publishes on every thank-you page the turnaround it works with.
8. How an agreement is reached
The site does not sell anything and does not process payments. There is no cart, there is no standard contract published and there is no page where an agreement is closed.
Every commercial agreement between a brand, an agency, a company or an organizer and OHMYBITZ is negotiated entirely by email, drafted to fit what that client needs and formalized in a document of its own. The same applies to a single creator taking part in an individual campaign and to several creators taking part in a collective campaign.
The financial terms, the deliverables, the schedule, the revisions, the content usage rights, the length of the license, the confidentiality and the law applicable to that agreement are set out in that document, which prevails over these terms in everything it governs. These terms govern the use of the site, not the commercial relationship.
9. No campaign runs on a variable model
It is a commercial rule of OHMYBITZ and it reaches every creator. None of them works a campaign, a training program or a spot at an event without a fixed budget.
Commission, affiliate deals, pay per sale, pay per referral, barter and any fully variable scheme are out, and there is no mixed version. In the case of an event, the rule covers the shape that scheme takes there, which is the creator showing up in exchange for the visibility the event gives them.
The forms read what you write and flag it when the proposal described fits one of those schemes. That notice is informative and the rule is not negotiated case by case.
10. The published floors
The site publishes a floor per product, and these are minimums for entering the conversation and not prices.
- Campaign with a creator from the roster. None below 2,500 US dollars.
- Training for companies. A floor of its own of 8,000 US dollars, with limited places per quarter. It is a different product and the campaign ranges do not apply to it.
- Appearance at an event. No published floor. The cost depends on the type of appearance, on the city and on the days of the schedule it takes up, so a single number for the whole roster would be made up.
OHMYBITZ can update these floors. The one that governs is the one published on the site at the time of the inquiry.
11. Categories the roster does not accept
The core of the roster, which is the technology and science communication creators, does not accept campaigns in certain categories. The current list and its exceptions live in the veto policy, which forms part of these terms by reference.
An inquiry about a vetoed category is declined, and that decision is not negotiated. OHMYBITZ can also decline any inquiry that, without being on the list, it considers incompatible with the creator's criteria or with its own.
12. Identifying sponsored content
Every sponsored piece that comes out of an agreement with OHMYBITZ is identified as advertising, clearly and in the language of the content, with the tool the platform offers for that where one exists.
The specific obligation, its format and its placement are set in the contract for each campaign, in accordance with the rules of the creator's country of residence and those of the country the campaign is aimed at. The brand supplies the list of claims that may be made about its product and is answerable for their being substantiated.
13. The comedy and entertainment segment
The site publishes a segment of comedy and entertainment creators with its own page and its own message. For those creators, OHMYBITZ handles the commercial negotiation through a single point of contact.
The core veto policy does not extend to that segment, and its criteria are settled in the conversation for each campaign.
14. Sending a profile to request representation
A creator can send their profile for OHMYBITZ to evaluate. The media kit is mandatory on that form, because without it there is nothing to review.
Sending a profile creates no representation relationship, does not oblige OHMYBITZ to evaluate it within a set period and does not oblige it to explain the reason for a negative answer. OHMYBITZ evaluates candidates from any sector, and its preference for programming, technology, science and science communication is a preference, not a requirement.
The representation relationship arises from a written and signed agreement, never from a submission through the site.
15. Suspension of access
OHMYBITZ may limit or block access to the site, and discard the submissions of a form, when it detects a use contrary to these terms, automated access or bulk sending. The measure applies without prior notice and without that giving rise to any right to compensation.
16. Governing law, language and changes
These terms are governed by the laws of the State of Florida, United States of America, and disputes about the site are submitted to the courts sitting in Miami-Dade County, Florida, with the same caveat set out in the legal notice.
Spanish is the reference language. Any version in another language exists to make reading easier and is interpreted by reference to the Spanish text, which prevails in the event of a discrepancy.
The house may update these terms. The version in force is the one published at this address, with its date in the panel above, and a material change is announced on the site before it takes effect. If a clause were to be invalid, the rest remains in force.
